Terms of Service

1. Acceptance of Terms

By accessing or using Arguably (the “Service”), creating an account, or clicking “Continue” on the login page, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and the operator of Arguably (“we”, “us”, or “our”).

2. What Arguably Is

Arguably is a fictional conversation game in which you interact with AI-generated characters in scripted emotional scenarios. The characters, situations, and outcomes are entirely fictional. Nothing in the Service constitutes professional advice of any kind — legal, medical, psychological, financial, or otherwise. The characters are not real people. Any resemblance to real persons, living or dead, is coincidental.

3. Eligibility

You must be at least 13 years old to use the Service. If you are located in the European Economic Area (EEA), United Kingdom, or any jurisdiction that sets a higher digital age of consent, you must meet that higher age requirement (typically 16 in most EEA countries). By using the Service, you represent and warrant that you meet the applicable age requirement. If you are under the applicable age, you must not use the Service.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@arguably.app if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or pose a security risk. You may not create multiple accounts to circumvent bans, rate limits, or leaderboard restrictions.

5. Content You Submit

Messages you send during gameplay (“User Content”) are processed in real time by our AI systems to generate character responses and compute your score. You retain ownership of your User Content. By submitting User Content, you grant us a limited, worldwide, non-exclusive licence to process, store, and use that content solely to operate and improve the Service. We may use anonymised, aggregated conversation data to improve the game engine and AI models. We will never publish identifiable User Content without your explicit consent.

6. Acceptable Use

You agree not to use the Service to: (a) generate or transmit content that is unlawful, harassing, threatening, defamatory, obscene, or otherwise objectionable; (b) attempt to reverse-engineer, scrape, or extract the scoring algorithm, prompts, or model weights; (c) abuse or overload the API, or use automated tools to interact with the Service; (d) impersonate another person or entity; (e) engage in any activity that violates applicable law, including data protection, export control, or intellectual property law. We may remove content and suspend accounts that breach these prohibitions without prior notice.

7. Intellectual Property

All game content — including characters, scenarios, scoring logic, visual design, and software — is owned by or licensed to us and is protected by intellectual property law. You may not copy, reproduce, distribute, or create derivative works of any part of the Service without our prior written consent. Your feedback and suggestions about the Service may be used by us freely without any obligation to you.

8. Third-Party Services

The Service relies on third-party providers including Anthropic (AI processing), Google (OAuth login), Neon (database hosting), Vercel (frontend hosting), Railway (backend hosting), and Resend (email delivery). Your use of the Service is also subject to those providers' terms and policies where they apply to you directly. We are not responsible for the availability or conduct of third-party services.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We are in active development and the Service may change or be unavailable without notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the greater of the fees you paid us in the 12 months preceding the claim, or £50 (fifty pounds sterling). Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may delete your account at any time by contacting us. We may suspend or terminate your access at any time for any reason, including breach of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 10, 11, and 13 survive termination.

13. Governing Law & Disputes

Arguably is an independent, unincorporated project. These Terms are governed by and construed in accordance with applicable law. We will always attempt to resolve disputes informally first — please contact us at support@arguably.app before pursuing any formal claim. If you are a consumer in the EU, you retain any mandatory rights granted to you under the laws of your country of residence, and you may use the European Commission's Online Dispute Resolution platform. If you are in India, disputes may be referred to a consumer forum under the Consumer Protection Act 2019.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page and, for material changes, notify you by email or in-app notice. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.

15. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right under these Terms is not a waiver of that right. These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements. You may not assign these Terms without our consent; we may assign them freely.
